Oregon Precision Industries, Inc. dba PakTech (“PakTech,” “we,” or “our”) is an Oregon corporation.  PakTech specializes in creating injection molded handles for multi-packing food and beverage products and providing related machines and tools to packing companies (“Our Services”). PakTech makes it easy for consumers to grab, carry, and release multiple products using a simple, minimal, 100% recyclable handle.  Please note that while our products are designed with the consumer’s convenience in mind, we only sell our products in the business-to-business (B2B) marketplace. 

 

We collect information through our websites www.paktech-opi.com and resources.paktech-opi.com, tradeshows, and through other means, such as when you contact us via telephone, email, or mail for information about Our Services. Your privacy is very important to us.  Accordingly, we have developed this Privacy Policy (the “Policy”) in order for you to understand how we collect, use, communicate, and disclose and make use of data collected from you by PakTech. 

 

This Policy explains what Personal Information we collect as a controller within the meaning of the General Data Protection Regulation (“GDPR”) and other applicable data protection legislation, how we use and share that data, and your choices and rights concerning your Personal Information. 

 

  1. Information We Collect.

 

When you use the Sites or otherwise interact with us, we receive and collect information, including personal information.  “Personal Information” includes any information you provide us that could reasonably be used to personally identify you.  The data we collect depends on the how you interact with us, and could include the following types of information, some of which may include Personal Information:

 

1.1       Information You Provide Directly to PakTech. 

 

We may collect the name of the business on behalf of which you are contacting us, your first and last name, email address, postal address, phone number, and other similar contact information. 

 

1.2       Information from Third-Party Services. 

 

We collect personal data from third parties to whom you give permission to share your personal data with us, such as if you reply to our posts on Instagram or Facebook.  We will only collect and use that information to the extent that such collection and use is permitted under by the third-party services.  Please review the privacy policies of third-party services before using them in connection with the Sites.

 

1.3       Technical Information.

 

  1. Cookies. Cookies are stored in a computer or other operating device’s memory during a user’s browsing session.  The cookies we use in connection with our Sites are automatically deleted from the user’s computer or operating device when the browser is closed and the session has ended.  These cookies usually store a session ID that does not personally-identify the user, and they allow users to navigate the Sites efficiently.  These cookies provide us information about Sites features used and activities conducted while using the Sites.  Generally, we use cookies to customize your experience while using the Sites. We may use cookies to compile aggregate data about user traffic on and user interaction with the Sites so we can offer better experiences and tools in the future.

 

Most browsers automatically accept cookies, but you can block cookies at any time by changing the preferences in your browser and/or deleting cookies from your hard drive or other operating device. You can also have the browser notify you when you receive a new cookie.  Please refer to your browser for information on how to disable and control cookies.  If you choose to block or delete cookies, our Sites may not function properly on your computer or other operating device, and certain features may not be available to you.

 

In addition to browser cookies, we may use other locally stored objects (sometimes referred to as “flash cookies”) stored in your hard drive or other operating device.  These flash cookies will not be deleted when you delete cookies from your browser, and even if you set your browser to not accept cookies, these cookies will still be stored on your hard drive or other operating device when you use our Sites.  We may use this technology for purposes such as information security and fraud prevention, and to collect and store information about your preferences and navigation to, from, and on our Sites.  We do not use this technology for online behavioral advertising purposes.  If you choose to disable or otherwise control flash cookies, our Sites may not function properly on your computer or other operating device, and certain features may not be available to you.

 

  1. Web Beacons. We may use web beacons or similar technologies to collect technical information about your use of the Sites and your viewing and use of emails we send to you.  Web beacons are graphic image files imbedded in a web page, Site feature, or email that provide a presence on such web page, feature, or email and send back to its home server information from the user’s browser.  The information collected by web beacons allows us to statistically monitor how many people are using the Sites and opening our emails, and for what purposes.  For example, we might place a web beacon in a marketing email to notify us when a user clicks on the link in the email.  We do not collect Personal Information with web beacons, and we do not link information retrieved from web beacons directly with any Personal Information you have given us.]

 

  1. How and Why We Use Your Personal Information.

 

We limit our use of your Personal Information to uses reasonably necessary to or compatible with the purposes described in this Policy.   We will obtain your consent prior to using it for any other purpose.  See Section 5 of this Policy for definitions of the legal bases listed. 

 

2.1       Providing and Supporting our Sites.

 

We use your Personal Information to provide and support the operation of our Sites, including

to help diagnose problems with the Sites, to make the Sites more compatible with the technology used by our users, to analyze statistical use patterns, and to otherwise improve our Sites. For example, we may use Personal Information to track what our users look at most so we can recognize and provide more of the desired content.  Legal basis: Consent; Contract; Legitimate Interests.

 

2.2       Customer Support.

 

We may use your Personal Information to communicate changes about Our Services or provide support via phone or email. Legal basis: Contract; Legitimate Interests.

 

2.3       Marketing.

 

We use your Personal Information to respond to inquiries through our website or other contact methods about PakTech that you send to us and to send users messages about updates, new features, and other relevant information. We will only send you email marketing information if you consent to us doing so when you provide your contact information to us or as otherwise permitted by this Policy and applicable law. Legal basis: Consent; Contract.

 

If we use your Personal Information to send you marketing communications, we will provide you with an unsubscribe mechanism to opt-out of receiving future marketing communications, or you can contact us to request that we not send you marketing communications. If you request that we not contact you for marketing purposes (either by using the unsubscribe mechanism or contacting us), we reserve the right to contact you for non-marketing purposes relating to our Services or other use of our Sites.

 

  1. Information Shared with Third Parties.

 

Except in the circumstances described in this Policy, PakTech does not share, sell, rent, license, trade, or otherwise transfer or disclose your Personal Information with or to third parties for their promotional purposes.  We may share de-identified, aggregated information without restriction.

 

3.1       Third-Party Service Providers.

 

We share information with our third-party service providers who assist us by performing services related to our operation of Our Services (such as hosting our website and customer payment processing) and to conduct marketing on our behalf.  Some external service providers may also collect information directly from you (for example, a payment processor may request your billing and financial information) as a third-party service in accordance with their own privacy policy. Such external service providers do not share your financial information, like credit card number, with us, but may share limited information with us related to your purchase, like your zip or postal code or other information necessary to confirm your payment.

 

3.2       Third-Party Analytics Services.

 

We may use third-party analytics services to assist us in better understanding users of Our Services and how to help serve them better.  For example, we are able to determine customer interest in specific products we may have advertised online. The information we receive from these third parties may be re-associated with your Personal Information after we receive it back from these third parties.

 

3.3       Merger, Acquisition, or Sale.

 

We may transfer your Personal Information to another entity if we are involved in a merger, acquisition, reorganization, restructuring, or other sale or transfer of all or any portion of our assets or business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which information of users of our Sites are among the assets transferred. In this event, we will, if allowed, use reasonable efforts to notify you when your information is transferred to a third party (this notification may be made via email to you or by posting a prominent notice on the Sites). Unless you consent otherwise, your Personal Information will remain subject to the promises made in this Policy, even after the transfer. But any information you provide after the transfer will likely be subject to a new privacy policy, and you should review that policy.

 

3.4       Required by Law.  

 

PakTech reserves the right to release your information if we believe in good faith that (i) such release is required to comply with any law, rule, or regulation, or any search warrant, subpoena, court order, or similar legal process; or (ii) disclosure is necessary to protect or enforce our rights or property, to protect the rights or property of others, to protect your safety or the safety of others, in emergency situations, to defend against legal claims, to enforce our contractual or other rights, or to take action regarding illegal activities or suspected fraud.

 

  1. International Transfer of Data.

 

Personal Information you provide to us may be transferred to our authorized third-party service providers located globally, including in the United States. Other countries may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. When we transfer information of individuals in the European Economic Area (“EEA”) or the United Kingdom (“UK”) to our authorized third-party service providers, we make use of standard contractual data protection clauses, which have been approved by the European Commission and Information Commissioner’s Office, as applicable.

 

  1. Legal Basis for Processing Personal Information in EEA or UK.

Our legal basis for collecting and using the Personal Information described above will depend on the Personal Information collected and the specific context in which we collect it.  However, we will normally collect Personal Information from you only where we have your consent to do so or where we need the Personal Information to perform a contract with you.  In some cases, we may also have a legal obligation to collect Personal Information from you.  If you are located in the EEA or the UK we are required to notify you about the legal basis upon which your Personal Information is processed, which are as follows: 

  1. “Contract” means that processing your Personal Information is necessary for us to fulfill the obligations of a contract between you and Oregon Precision Industries, Inc.
  2. “Legitimate Interests” means processing your Personal Information is necessary to further our legitimate interests, and where our legitimate interests are not overridden by your data protection interests or fundamental rights and freedoms. “Legitimate Interests” include: delivering, developing, and improving the Sites, understanding your behavior when using the Sites, measuring the effectiveness of marketing campaigns, IT security, and marketing.
  3. “Consent” means processing your Personal Information is done with your consent. You can revoke your consent at any time by emailing your revocation request to info@paktech-opi.com. If you revoke your consent, we will stop processing your Personal Information, unless there is another legal basis for continuing to process your Personal Information.
  4. “Legal Requirement” means processing of your Personal Information is necessary for compliance with a legal obligation to which we as the controller are subject.

7.2       Exercise of Rights.

 

You may submit a request to exercise any of the rights described above to info@paktech-opi.com. Consistent with applicable law, we may ask for proof of your identity before fulfilling your request, and we may ask for additional forms of verification depending on the nature of the Personal Information requested. We may retain certain data about you for legal and internal business purposes, such as fraud prevention, in accordance with applicable laws.

 

  1. California Shine the Light Law.

 

Under California Civil Code sections 1798.83-.84, California residents are entitled to ask for a notice identifying the categories of personal customer information that we share with our affiliates and/or third parties for marketing purposes and providing contact information for such affiliates and/or third parties.   1. Links to Third-Party Websites.

 

This Policy applies only to information collected through your use of our Sites. The Sites may contain links to other websites, products, or services that are not owned or controlled by PakTech.  We are not responsible or liable for the privacy practices or other actions of these third parties or their websites, products, or services. These third parties may have their own privacy and security policies.  You should review such policies to determine what information about you may be collected and used when you use these linked websites, products, or services. PakTech also does not track its users over time and across third-party websites to provide interest-based advertising and therefore does not respond to Do Not Track signals.

 

  1. Security of Information; Disclaimer.

We maintain a combination of reasonable and appropriate physical, organizational, administrative, and technological procedures and controls to protect your data form unauthorized access, use, loss, alteration, destruction, modification, and other malicious acts. 

 

We protect the security of your Personal Information during transmission by using Secure Sockets Layer (SSL) software or other encryption technology, which encrypts Personal Information you input. Wherever appropriate, we obfuscate and/or encrypt Personal Information in our systems and/or during information transfer. However, no method of transmission over the internet is 100% secure and we cannot absolutely guarantee the security of your Personal Information.

  1. Children’s Privacy.

 

Our Sites are not directed to children.  Anyone under the age of 18 is prohibited from using the Sites.  We do not knowingly collect information from (or permit submission of information by) anyone under age 18.  If we learn that we have received information from a child under age 18 in violation of this Policy, we will delete that information from our files.

  1. Unenforceability.

 

If any part of this Policy is determined to be invalid, illegal, or unenforceable, pursuant to applicable law, then the invalid, illegal, or unenforceable provision will be deemed superseded by a valid, legal, and enforceable provision that most closely matches the intent of the original provision, and the remainder of this Policy shall continue in full force and effect.

 

  1. Policy Updates.

 

We may update this Policy in our discretion. We will post any new Policy here, and you should review this Policy regularly to make sure you are aware of its terms. You can determine if this Policy has been revised since your last visit to our Sites by referring to the effective date.  We may provide notification of significant changes to this Policy through our Sites.  Your use of the Sites following a revision to this Policy constitutes your acceptance of and agreement to the Policy, as revised by us.
