PakLock Terms

Certified Product Disclosure
PakTech’s Paklock product (the “Product”) has been tested and certified as compliant with applicable child-resistant packaging standards by a recognized independent third-party laboratory in accordance with CPSC 16 CFR Part 1700.20.

PakTech provides this certification solely as a representation of the Product’s design compliance at the time of testing. It is the responsibility of the purchaser or downstream user to ensure that the Product is used as intended, integrated appropriately with the can and contents, and complies with all applicable local, state, and federal regulations regarding controlled or regulated substances and packaging requirements.

Indemnification
Purchaser agrees to indemnify, defend, and hold harmless PakTech, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: a.) Misuse, alteration, or misapplication of the Product, b.) Failure to comply with applicable laws and regulations relating to packaging, labeling, and sale of controlled substances, c.) Claims that arise due to the contents of the can, including but not limited to hemp or other regulated substances, d.) Any failure by purchaser or its affiliates to ensure appropriate use or disclosure of child-resistant features in its marketing, labeling, or distribution.
This indemnity shall survive termination or expiration of any agreement between PakTech and Purchaser.
